Terms of Service

1. Agreement to Terms

By engaging Freshly Designs for web design services, you agree to these Terms of Service. These terms govern all projects and services provided by Freshly Designs to clients.

If you do not agree with any part of these terms, please do not proceed with our services.

2. Services

Freshly Designs provides website design and development services for small and medium businesses. The specific scope, deliverables, timeline, and price for each project are agreed upon before work begins and confirmed in writing (email confirmation is sufficient).

Services include but are not limited to: website design, website development, landing pages, blog setup, contact form integration, SEO foundations, and related digital services as described in our pricing plans.

3. Payment

Our core website packages are priced as one-time payments. Payment is required before work begins. All payments are processed securely through Stripe.

Add-on services and ongoing services (hosting, maintenance retainers) are billed as agreed and described in your service agreement. Recurring services may be cancelled with 30 days' written notice.

All prices are listed in USD. Payments are non-refundable once work has commenced, except where required by applicable law.

4. Project Process and Timelines

Delivery timelines begin from the date we receive all required information from you (business details, content, images, and any other materials needed to complete the project). Delays in providing required materials may extend the delivery timeline.

You will have the opportunity to review your website before it goes live. We include one round of revisions within the agreed scope. Additional revisions or scope changes may be subject to additional fees, which will be agreed upon in advance.

5. Client Responsibilities

To enable us to deliver your project on time, you agree to:

• Provide all required content, images, and information promptly when requested
• Designate a single point of contact for approvals and feedback
• Respond to review requests within 3 business days to avoid project delays
• Ensure that all content and materials you provide do not infringe on any third-party rights

6. Intellectual Property and Ownership

Upon receipt of full payment, you own 100% of the final website and all custom design work created specifically for your project. This includes the design files, code, and content.

Freshly Designs retains the right to display the completed project in our portfolio and use it for promotional purposes unless you request otherwise in writing before project completion.

Third-party assets used in your project (stock photos, fonts, plugins, themes) are subject to their respective licences. We will inform you of any licences that require ongoing fees.

7. Hosting and Domain

If you use our hosting service, your website will be hosted on our Vercel account. You may move your site to your own hosting at any time. If you discontinue our hosting service, we will provide you with all necessary files and assistance to migrate your site within 14 days of cancellation.

Domains registered or managed through Freshly Designs remain your property. A transfer fee applies if you wish to move domain management to a different registrar (see our pricing page).

8. Limitation of Liability

Freshly Designs will not be liable for any indirect, incidental, or consequential damages arising from the use of our services or your website, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability for any claim related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Warranties

We warrant that our work will be completed with reasonable skill and care, and that the final website will function as described in the agreed scope at the time of delivery.

We do not guarantee specific search engine rankings, traffic levels, or business outcomes from your website. SEO results depend on many factors outside our control.

10. Termination

Either party may terminate a project before completion with written notice. In the event of termination by the client after work has commenced, payment for work completed to date is due. In the event of termination by Freshly Designs, a pro-rated refund for work not yet completed will be issued.

11. Governing Law

These terms are governed by the laws of the jurisdiction in which Freshly Designs operates. Any disputes will be resolved through good-faith negotiation before pursuing formal legal action.

12. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We will notify active clients of any material changes by email.
