Terms of Service

1. Agreement to Terms

These Terms of Service govern all projects and services provided by Streamline Logik LLC, doing business as Freshly Designs, to clients. By engaging Freshly Designs — including by completing a purchase at checkout — you agree to these terms.

If you do not agree with any part of these terms, please do not proceed with our services.

2. Services

Freshly Designs provides website design and development services for small and medium businesses. The specific scope, deliverables, timeline, and price for each project are agreed upon before work begins and confirmed in writing (email confirmation is sufficient).

Services include but are not limited to: website design, website development, landing pages, blog setup, contact form integration, SEO foundations, and related digital services as described in our pricing plans.

3. Payment

Website packages are priced as one-time payments, structured as a deposit plus a balance due at launch. The deposit (50% of the package price) is charged at checkout and is required before work begins. The remaining balance is due before the site is pointed to your domain and goes live. We will send a secure invoice for the balance at that time.

Additional services beyond the package scope (logo design, content writing, social media graphics, etc.) are scoped during your kickoff call and invoiced separately before work begins. Every website package includes 3 months of managed hosting at no additional charge, beginning at site launch. After the included period, hosting continues at $49/month unless the client transfers the site to their own Vercel account. Either party may cancel ongoing hosting with 30 days' written notice.

All prices are listed in USD. Payments are processed securely through Stripe. Charges will appear as FRESHLYDESIGNS on your card or bank statement. See Section 10 for the full cancellation and refund policy.

4. Project Process and Timelines

Delivery timelines begin from the date we receive your completed project brief and all required materials (business details, content, images, and any other assets needed). Delays in providing required materials extend the timeline by an equal number of business days.

Each package includes a defined number of revision rounds (1 round for the Online Presence Package, 2 rounds for the Customer Acquisition System). Each round consists of one consolidated feedback list — all changes submitted together and implemented together. Additional rounds are available at $149 per round, agreed in writing before work begins.

Following launch, we provide post-launch support for bugs and issues within the agreed project scope. The support window (14 days for the Online Presence Package, 30 days priority for the Customer Acquisition System) is specified in your order confirmation. Support does not cover new feature requests, additional pages, or issues caused by third-party tools or changes made after launch.

5. Client Responsibilities

To enable us to deliver your project on time, you agree to:

• Provide all required content, images, and information promptly when requested
• Designate a single point of contact for approvals and feedback
• Respond to review requests within 3 business days to avoid project delays
• Ensure that all content and materials you provide do not infringe on any third-party rights

6. Intellectual Property and Ownership

Upon receipt of full payment, you own 100% of the final website and all custom design work created specifically for your project. This includes the design files, code, and content.

Freshly Designs retains the right to display the completed project in our portfolio and use it for promotional purposes unless you request otherwise in writing before project completion.

Third-party assets used in your project (stock photos, fonts, plugins, themes) are subject to their respective licences. We will inform you of any licences that require ongoing fees.

7. Hosting and Domain

Every website package includes 3 months of managed hosting at no additional charge, beginning at site launch. During this period your site is hosted on Vercel's infrastructure on your behalf. After the included period, hosting continues at $49/month unless you notify us that you wish to transfer the site to your own Vercel account or developer, at which point we provide all website files and reasonable migration assistance within 14 days at no charge.

Hosting availability is subject to Vercel's service conditions; we do not guarantee specific uptime levels and are not liable for downtime caused by third-party infrastructure. You may move your site to your own hosting at any time.

When we register a domain on your behalf, the domain is registered in your name and belongs to you. Annual renewal ($29/yr) is invoiced separately. You may transfer management of your domain to any registrar at any time at no additional charge.

8. Limitation of Liability

Freshly Designs will not be liable for any indirect, incidental, or consequential damages arising from the use of our services or your website, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability for any claim related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Warranties

We warrant that our work will be completed with reasonable skill and care, and that the final website will function as described in the agreed scope at the time of delivery.

We do not guarantee specific search engine rankings, traffic levels, or business outcomes from your website. SEO results depend on many factors outside our control.

10. Cancellation and Refunds

Client cancels after work has begun: The deposit is non-refundable. If work has progressed beyond 50% of the agreed scope, a pro-rated invoice for work completed will be issued.

Additional services: Services scoped and invoiced separately — such as logo design, content writing, domain registration, and workspace configuration — are non-refundable once work has commenced. Any cancellation request must be submitted in writing before work begins. Completion of a service (for example, a registered domain or a configured workspace) constitutes delivery regardless of whether the client makes active use of it.

Rush Delivery: Non-refundable once the project brief has been received, as schedule prioritisation takes effect immediately upon kick-off.

Project abandonment: If the client does not respond or provide required materials for 30 consecutive days, the project will be considered abandoned and the deposit forfeited.

Freshly Designs cancels: A full refund of all amounts paid will be issued within 5 business days.

11. Governing Law

These terms are governed by the laws of the State of Georgia. Disputes will first be addressed through good-faith written communication before any formal legal action is pursued.

12. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We will notify active clients of any material changes by email.

13. Service Scope and Deliverables

Each package and add-on service has a defined scope of work, which sets out what is included, what is not included, and any important notes. This scope is presented to you in the quote builder before checkout and is included in your order confirmation email. By completing checkout, you acknowledge that you have reviewed and accepted the scope for the services you selected.

Work outside the agreed scope — such as additional pages, extra revision rounds, or new features requested after a project brief is finalised — will be quoted separately and requires written approval before any work begins.
